Board of Adjustment

PURPOSE AND DUTIES
The purpose of the Board of Adjustment is to:

  1. Hear and decide an appeal that alleges error in an order, requirement, decision, or determination made by an Administrative Official in the enforcement of the zoning ordinance No. 0102
  2. Hear and decide special exceptions to the terms of the zoning ordinance when the ordinance requires the Board to do so;
  3. Authorize in specific cases a variance from the terms of a zoning ordinance if the variance is not contrary to the public interest and, due to special conditions, a literal enforcement of the ordinance would result in unnecessary hardship, and so that the spirit of the ordinance is observed and substantial justice is done.

MEMBERSHIP
The Board of Adjustment is composed of five (5) regular members appointed by City Council.    The Council also appoints four (4) alternate members to serve in the absence of a regular member.  If you are interested in serving as a Board of Adjustment member, please submit the application as consideration for the next term.

MEETINGS
Meetings of the Board of Adjustment are held as necessary to comply with the requirements of section 51.001 and 51.012 of the Texas Local Government Code.  The Chairperson has established a regular schedule for meetings, however, the Board or Chairperson may call special meetings, move meetings due to conflicting schedules or cancel meeting where there are no matters to be heard.
